TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) apply to the sale of products listed on our website. By confirming an order through our website or by email you acknowledge that you have read and accepted these Terms.

1. DEFINITIONS

1.1 Where we use the words “we”, “us” or “our” we mean My Collective Limited.

1.2 Where we use the words “you” or “your” we mean the customer.

1.3 “Product” means any product advertised or shown on our website.

2. SERVICE AVAILABILITY

    2.1 We will only accept orders within New Zealand.

    3. HOW THE CONTRACT IS FORMED

    3.1   By placing an order online or by email, you are making an offer to purchase a Product from us. After you make an order, we will send you an e-mail acknowledging this within three (3) business days. Our email to you will constitute acceptance of your order. The agreement between you and us is binding when we send you that email.

    3.2  When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the payment method used, and that there are sufficient funds to cover the cost of the products.

    4. DELIVERY

    4.1   Delivery will be made to you in the month of December but before 23 December unless otherwise agreed in writing.

    4.2  Delivery will be deemed to have occurred when the Product has been delivered to the address specified by you in your order.

    5. PRICE AND PAYMENT

    5.1 The price payable for the Product shall be as shown on the website. Prices advertised on the website include New Zealand Goods & Services Tax (“GST”). Delivery charges are shown separately when ordering and must also be paid in advance.

    5.2  Payment must be made by one of the methods specified on our website. We will require full payment at the time we accept your order (see clause 3.1).

    6. GLUTEN FREE PRODUCTS

    6.1 You acknowledge that our gluten free products will be produced using gluten free ingredients but will be baked in the same location as non gluten-free products.

    7. CONSUMER GUARANTEES ACT 1993

    7.1 Nothing in this contract shall exclude or limit your statutory rights as a consumer under the Consumer Guarantees Act 1993.

    7.2 Where you order the Product for business purposes our total liability to you under the Contract shall not exceed the amount paid by you for the Product.

    8. INTELLECTUAL PROPERTY RIGHTS

    8.1 All and any intellectual property rights in connection with the Product, our business or this website are owned by us absolutely. This includes our patents, copyright, trademarks, designs, ideas, concepts, and anything we create.

    9. NOTICES

    9.1  All notices must be given by post or by email. Our email address is sally@mycollective.co.nz. Your notice details are those you entered when you placed the Order.

    9.2  Notice will be deemed received and properly served:

    9.2.1 Four (4) days after the letter is posted; or

    9.2.2 Once the recipient has acknowledged acceptance of the email.

    10. LAW AND JURISDICTION

    10.1 These terms and conditions are governed by New Zealand law. Any dispute associated with these Terms will be subject to the exclusive jurisdiction of the New Zealand Courts.
